Shaw failed to filed his reply in the case filed by Sapna Gill, a social media influencer.
The court gave Shaw one more chance to answer to Gill's criminal revision appeal, which questions a magistrate court's previous decision not to file an FIR against the cricketer. The sessions court had already asked Shaw to answer to Gill's petition several times. Despite a final warning during the previous hearing, Shaw did not submit his response by Tuesday's hearing.
"Still, one more chance is granted for a cost of Rs 100," the judge stated before scheduling the next hearing for December 16, as per the Times of India.
Gill's attorney, Advocate Ali Kaashif Khan, expressed concerns about Shaw's conduct in court, stating, "This has been his regular way of handling the case despite being summoned many times."
The case stems from an event that happened on February 15, 2023, at a pub in Andheri, Mumbai. According to police investigations, Shaw got into a fight with Gill's friend Shobit Thakur when he refused to take any more selfies with him at around one in the morning.
When Shaw and his friend Ashish Surendra Yadav were exiting the venue, things became heated. Police say Shaw fled unscathed, but Thakur was allegedly attacked with a baseball bat.
Yadav was allegedly pursued by a group of six people, including Thakur and Gill, who demanded Rs 50,000. After the police filed a complaint against the organization, Gill was taken into custody on February 17, 2023. Three days later, she was freed on bail.
Gill's account of what happened is very different. She claims that Thakur and she were invited to join Shaw and Yadav for drinks at their VIP table. She claims that Shaw and Yadav attacked Thakur when he asked for selfies.
Gill alleges that Shaw sexually and physically attacked her when she tried to step in. She accused the cricket player of assault, molestation, and outraging her modesty in a counter-complaint.
In response to Gill's allegation, the magistrate court first ordered a police investigation rather than filing a formal complaint. In April 2024, Gill then filed a criminal revision petition with the sessions court.
Shaw must now pay the symbolic fine and provide his response before the next hearing, which is set for December 16, in order for the case to continue.
